The Buckeye Institute Outlines Practical Recommendations for Medicaid Redetermination Process

The Buckeye Institute released a new policy report, Medicaid: Why and How States Must Review Eligibility, that offers recommendations on how states should approach the Medicaid redetermination process that is required now that the federal Covid-19 public health emergency is over. “By adopting this approach, states can conduct efficient eligibility reviews, avoid significant budgetary shortfalls, and ensure that only people eligible for Medicaid receive benefits.”

The Buckeye Institute & NFIB Call on U.S. Supreme Court to Protect Taxpayers

The Buckeye Institute filed an amicus brief in Moore v. United States, calling the U.S. Supreme Court to reverse a ruling out of the Ninth Circuit Court of Appeals that would expand congressional authority to levy taxes well beyond what the Constitution and court precedent allow. The decision is “inconsistent with the U.S. Constitution and more than a century of U.S. Supreme Court precedent.” The National Federation of Independent Business joined Buckeye in filing the brief.

“In Brief to Ohio Supreme Court, The Buckeye Institute Argues Public Records Must be Turned Over”

The Buckeye Institute filed an amicus brief with the Ohio Supreme Court in Hicks v. Union Township, arguing that it is the duty of the General Assembly—not the courts—to determine what information should be excluded from the definition of public records. “Increasingly, Ohio courts have relied on the judge-made administrative convenience doctrine to shield government records from the public.”

“In Public Comments, The Buckeye Institute Urges Ohio to Allow Qualified Part-Time Lawyers to Practice Law”

The Buckeye Institute filed public comments with the Ohio Supreme Court urging the court to adopt the proposed amendments and admit qualified part-time attorneys—practicing in other jurisdictions—to the Ohio Bar without needless regulatory hardships. “By removing needless regulatory restriction, Ohio would encourage part-time attorneys to move to the Buckeye State, increasing the availability and affordability of legal services to those in need.”

In The Washington Times, The Buckeye Institute and the Center of the American Experiment look at the tough choices Alaska lawmakers face to balance the state’s budget. The authors write, “While the temptation may be strong to try to raise more money from the energy industry, even in conservative states, trying to plug the budget hole by taxing petroleum producers will inevitably backfire by reducing Alaska’s energy production.”

The Buckeye Institute unveiled its updated public salary database, which includes salary information through 2022 for public employees in Ohio’s K-12 public schools, state employees, Ohio’s public universities, and local governments in Akron, Canton, Cincinnati, Cleveland, Columbus, Dayton, Toledo, and Youngstown. With nearly 18.7 million visits to its salary database, Buckeye is a recognized pioneer in increasing government transparency. Its work to make public information easily accessible was instrumental in the creation of the Ohio Check Book.

“In Amicus Brief, The Buckeye Institute Argues That Liberty Requires Accountability”

The Buckeye Institute filed an amicus brief in Braidwood Management v. Becerra with the U.S. Court of Appeals for the Fifth Circuit, arguing that the Affordable Care Act violated the appointments clause of the U.S. Constitution when it elevated the Preventative Services Task Force from a purely advisory role into a rulemaking body without also reforming the process by which the members of the task force were appointed and confirmed.

The Buckeye Institute released a new policy brief, A Federalism Opportunity in A Congressional Failure: How States Can Fix the Data Privacy Patchwork, urging states—in the wake of Congress’s failure to adopt comprehensive data privacy legislation—to work together to harmonize state-level data privacy rules, which, if left unaddressed could cost businesses and consumers $98 billion to $112 billion annually. “[S]tates can and should take the lead and pass data privacy legislation that minimizes compliance costs while effectively protecting consumer data privacy.”

“The Buckeye Institute-Led Coalition Files Public Comments, Demonstrates Failings of Proposed EPA Rule”

The Buckeye Institute led a coalition of free-market organizations in filing public comments on the U.S. Environmental Protection Agency’s proposed rule for new and existing fossil fuel-fired power plants. The Frontier Institute in Montana, Caesar Rodney Institute in Delaware, John Locke Foundation in North Carolina, and Mackinac Center for Public Policy in Michigan joined Buckeye in filing the comments. The proposed rule could exacerbate the impending energy security and reliability crisis.
