The Buckeye Institute Files Amicus Brief with U.S. Supreme Court Challenging Sweeping EPA Authority

The Buckeye Institute filed an amicus brief in the United States Supreme Court in West Virginia v. Environmental Protection Agency (EPA) urging the court to rein in the administrative power of the EPA and arguing that rules regulating private businesses violate the court’s major questions doctrine. “With more than 350,000 Ohioans directly or indirectly employed in either the mining or oil and gas industries, the proposed EPA rules clearly meet the ‘vast economic and political significance’ threshold in the high court’s major questions doctrine.”

The Buckeye Institute commented on newly released employment data from the Ohio Department of Job and Family Services, saying, “After a strong October jobs report, Ohio enjoyed some more holiday cheer with another strong report in November. The unemployment rate fell from 5.1 percent to 4.8 percent and more workers returned to the job market with a small increase in the labor force participation rate. Although Ohio continued to lag behind the national numbers, November’s report is good news for the Buckeye State.”

In Memoriam: Linda Whetstone

Some intellectual forces of nature are dreadful bores and terrible dinner companions. Linda Whetstone was exactly the opposite. She personified fun, and her mischievous sense of humor could bring down the house. She made us better, too. She was the brightest star at every event, and was dancing during her Mont Pelerin Society conference at Universidad Francisco Marroquín (UFM) in Guatemala last month like she hadn’t a care in the world. That image and her immeasurable impact will live in our hearts forever.

Robert Alt, president and chief executive officer of The Buckeye Institute, issued a statement on the U.S. Court of Appeals for the Sixth Circuit’s denial of Buckeye’s petition for an initial en banc hearing, saying, “The denial of The Buckeye Institute’s petition for an initial en banc hearing in Phillips v. OSHA is disappointing. An en banc hearing would have ensured a faster resolution to these cases which would have given our clients—who will suffer substantial and irreparable economic harm if the OSHA vaccine mandate is enforced—greater certainty.”
