The Buckeye Institute Files Another Brief to Protect Taxpayers Against Biden’s Tax Mandate

The Buckeye Institute filed its amicus brief in Arizona v. Yellen calling on the United States District Court for the District of Arizona to stop enforcement of the federal tax mandate, which was included in the American Rescue Plan Act. “Without clear and unambiguous language of what the states are permitted and what they are forbidden, the Biden administration’s sweeping disregard for the principle of federalism must be overturned,” said Robert Alt, president and chief executive officer of The Buckeye Institute.

Washington State’s Initiative 1501 is a Clear Violation of the U.S. Constitution

The Buckeye Institute filed its amicus brief in Boardman v. Inslee calling on the United States Supreme Court to overturn a union-backed Washington state law that prohibits access to contact information for public employees to anyone except for unions themselves, a clear violation of the First Amendment. Boardman v. Inslee challenges Washington’s Initiative 1501, a ballot initiative funded by government unions that restricts access to the contact information of public employees to any groups except unions.

Robert Alt, president and chief executive officer of The Buckeye Institute, issued a statement after the Ohio House of Representative passed House Bill 110, Ohio’s biennial budget, saying, “As the Ohio Senate continues its own work on the budget, The Buckeye Institute urges lawmakers to cut unnecessary spending, give parents the tools and resources they need to ensure their children’s educational success, and offer weary Ohioans and Ohio’s economy a boost by enacting meaningful tax relief.”

Rea S. Hederman Jr., executive director of the Economic Research Center at The Buckeye Institute and vice president of policy, commented on newly released employment data from the Ohio Department of Job and Family Services, saying, “At this point last year, Ohioans knew that the impacts of the pandemic would be severe as the state faced a government ordered shutdown of many areas of the economy, but the full impact of the shutdown was not yet apparent. The Buckeye Institute: Ohio’s Budget Should Fund Priorities in a Time of Pandemic Recovery

The Buckeye Institute testified before the Ohio House Finance Committee on the policies in House Bill 110, Ohio’s biennial operating budget, which accounts for a little less than half of state spending. In his testimony, Greg R. Lawson, research fellow at The Buckeye Institute, noted that the COVID-19 pandemic has “created new challenges and new opportunities” for policymakers in crafting an operating budget that balances the “public’s health and safety, the economic needs of struggling small businesses, and maintain[s] a sustainable long-term budget that does not hinder growth…”

The Buckeye Institute Files Brief in Ohio v. Yellen Standing Up for Taxpayers Against Biden’s Tax Mandate

The Buckeye Institute filed its amicus brief in Ohio v. Yellen calling on the United States District Court for the Southern District of Ohio to stop enforcement of the federal tax mandate, which was included in the American Rescue Plan Act (ARPA). In its brief, Buckeye agrees with Ohio Attorney General Dave Yost that Congress lacks the authority to usurp state taxing authority, but Buckeye also notes that the court does not have to rule on this matter given the vagueness of the text in the ARPA.

In a piece for National Review, The Buckeye Institute and the Mackinac Center for Public Policy look at unconstitutional local tax grabs. Authors Jay Caron, senior litigator at The Buckeye Institute, and Patrick Wright, vice president for legal affairs at the Mackinac Center in Michigan write, “What’s a city official to do when a pandemic slams tax revenue? In our home states of Michigan and Ohio, state and local leaders have an odd — and unconstitutional — answer. They want cities to tax people who neither live nor work within their limits.”

“Following Victory in Columbus Tax Case, The Buckeye Institute Files New Tax Lawsuit Against City of Cleveland”

Following a significant victory in Denison v. Kilgore, The Buckeye Institute filed a new lawsuit on behalf of Manal Morsy—a Pennsylvania resident—asking for the court to declare unconstitutional an Ohio law that allows the city of Cleveland, Ohio to tax her income even though she does not live in Cleveland—or even the State of Ohio—and has not worked in Cleveland for more than a year.

In a new piece, The Buckeye Institute urges lawmakers to expand Ohio’s successful T-CAP program to all 88 counties. The program—which Andrew J. Geisler notes “reduce[s] prison overcrowding, save[s] taxpayer dollars on incarceration, and help[s] low-level, non-violent offenders get the treatment and rehabilitation they need to re-enter society successfully”—offers a cost-effective way to give offenders an opportunity at a second chance while still ensuring they pay their debt to society.

The Buckeye Institute Urges U.S. Supreme Court to Enforce Congressional Review Act

The Buckeye Institute filed its amicus brief calling on the U.S. Supreme Court to hear Kansas Natural Resource Coalition v. United States Department of the Interior and recognize the authority of courts to hear claims from private citizens seeking to enforce the 1996 Congressional Review Act—an act which preserves the U.S. Constitution’s essential system of checks and balances.
