The Buckeye Institute: University Endowments Must Adhere to Donor Intent

The Buckeye Institute submitted written testimony to the Ohio House Higher Education and Career Readiness Committee on the policies in Senate Bill 135, specifically those policies that would “safeguard donors and their generous gifts to Ohio’s institutions of higher education.” Greg R. Lawson, a research fellow at The Buckeye Institute, noted that the policies in the bill would “ensure that colleges and universities spend education endowment funds according to the endowment’s terms and consistent with donor intent.”

The Buckeye Institute Files Motion Demanding White House Stop Hiding Documents in OSHA Vaccine Mandate Case

The Buckeye Institute filed a motion with the U.S. Court of Appeals for the Sixth Circuit on behalf of its clients, Phillips Manufacturing & Tower Company and Sixarp LLC, demanding that the White House produce all communications and records regarding the initiation and development of President Biden’s vaccine mandate. The White House has been perfectly clear that it imposed the vaccine mandate through OSHA in order to circumvent limits on federal power, and that its true intent is not related to genuine concern for workplace safety, but is rather to increase individual vaccination rates writ large.

The Buckeye Institute Urges Ohio Supreme Court to Rein in Government Overreach

The Buckeye Institute filed an amicus brief asking the Ohio Supreme Court to hear Twism Enterprises v. State Board of Registration for Professional Engineers and Surveyors and end the practice of judicial deference to government agencies’ interpretation of law. “Since the beginning of the 20th century, federal courts have increasingly deferred to government agencies and allowed them to interpret the laws and rules that govern their work, effectively making unelected and unaccountable administrative agencies judge, jury, and executioner in questions relating to their statutory authority.”

The Buckeye Institute: Holidays Arrive Early in Ohio with a Strong Jobs Report

The Buckeye Institute commented on newly released employment data from the Ohio Department of Job and Family Services, saying, “The holidays arrived a little early in Ohio with a strong October jobs report that saw the unemployment rate fall from 5.3 percent to 5.1 percent and saw more workers return to the labor force. The decline of two-tenths of a percent matched the national decline of 4.8 to 4.6 percent, signaling that in Ohio, and across the country, workers are finding new jobs and filling the record-high openings.”

The Buckeye Institute Files Motion Asking Full 6th Circuit Court to Hear All OSHA Vaccine Mandate Challenges

The Buckeye Institute filed a Petition for Initial Hearing En Banc to have Phillips v. U.S. Department of Labor, Buckeye’s case challenging the Biden administration’s vaccine mandate—as well as all of the other related cases that have been consolidated in the U.S. Court of Appeals for the Sixth Circuit—heard by the full court. “An en banc review will ensure that the full court is able to address the important administrative law and constitutional questions raised by our plaintiffs who would suffer substantial and irreparable harm as outlined in The Buckeye Institute’s case.”

The Buckeye Institute’s Robert Alt Reacts to OSHA Vaccine Mandate Cases Being Consolidated in the 6th Circuit

Robert Alt, president and chief executive officer of The Buckeye Institute and counsel of record representing Phillips Manufacturing and Sixarp LLC against OSHA's vaccine mandate, reacted to Tuesday’s announcement that all cases filed nationwide against the OSHA vaccine mandate have been consolidated into a single case with the United States Court of Appeals for the Sixth Circuit, where The Buckeye Institute was the first to request a stay of the OSHA mandate in the Sixth Circuit with its Phillips v. U.S. Department of Labor.

The Buckeye Institute Celebrates Win in Tax Mandate Case

The Buckeye Institute prevailed in another federal case protecting taxpayers from the Biden administration’s tax mandate included in the American Rescue Plan Act (ARPA). In West Virginia v. Yellen, the United States District Court for the Northern District of Alabama Western Division agreed with the arguments presented by The Buckeye Institute in ruling that the tax mandate in ARPA was impermissibly ambiguous and thus exceeded Congress’s constitutional authority to restrict how states spend federal grant money.

Buckeye Institute-Championed Policies Would Enable ‘Fintech’ Companies to Develop New and Better Services for Customers

The Buckeye Institute testified before the Ohio Senate Financial Institutions and Technology Committee on the policies in Senate Bill 249, which would make Ohio a more attractive place for financial technology companies to move to or expand by cutting red tape and complicated regulations that impede companies from developing and offering innovative products to customers. This new “regulatory sandbox” approach to oversight would enable fintech companies to develop new and better services for customers.

The Buckeye Institute: Making Telehealth Permanent Will Increase Access to Care

The Buckeye Institute testified before the Ohio Senate Health Committee on the policies in House Bill 122, which would permanently expand access to telehealth for all Ohioans. With Ohio’s current emergency COVID-19 rules on telehealth access set to expire on December 31, 2021, many Ohioans are at risk of losing access to this vital service unless lawmakers act and give all Ohioans “equal telehealth access to their healthcare providers.”

“As Lawmakers Review Occupational Licenses, The Buckeye Institute Identifies 63 Licenses Ohio Should Eliminate or Reform”

As the Ohio House State and Local Government Committee continues its review of Ohio occupational licenses, The Buckeye Institute released a new policy brief, Opening Doors II: Occupational Licensing Reform in Ohio After Senate Bill 255, where it identified 63 licenses that the state should eliminate or reform to make Ohio more economically competitive and make it easier for people to earn a living. In its review, Buckeye identified 40 license or certification requirements that should be eliminated and another 23 requirements that should be modified.
