The Buckeye Institute Files Third Lawsuit Demanding Recognition of Public-Sector Workers’ First Amendment Rights

The Buckeye Institute filed its third lawsuit in Maine calling for an immediate end to laws that compel public-sector employees who have refused to join a union to accept forced union representation. “In filing this lawsuit, and others like it across the country, The Buckeye Institute is calling for an end to the unconstitutional, un-American, and unfair practice of compelled ‘exclusive representation.’ It is long past time to recognize that public employees have the same right to speak for themselves that everyone else has.”

The Buckeye Institute: Incomplete Ohio Department of Medicaid Report Makes Unbiased Assessment of Medicaid Expansion Impossible

The Buckeye Institute issued a statement following the release of the 2018 Medicaid Expansion Assessment by the Ohio Department of Medicaid. “It is impossible to assess the accuracy of the Ohio Department of Medicaid’s claims in its latest assessment report, which does not include even a basic methodology. Unfortunately, without a methodology, this report does little to advance our understanding of the impact of Medicaid expansion.”

The Buckeye Institute: States Should be Able to Enact Commonsense Health Care Reforms

The Buckeye Institute submitted public comments on behalf of Kentucky’s Medicaid work and community engagement requirement. “[T]oo often, the federal government has denied or unduly delayed requests from the states to allow them to enact commonsense health care reforms, and unfortunately, the federal judiciary has joined that effort. With the court’s ruling in the Kentucky case, one more roadblock has been put in the way of states…to gain the flexibility they need to ensure their citizens can have healthy and prosperous lives.”

The Buckeye Institute: Protectionist Trade Policies are Putting Ohio’s Economic Gains at Risk

The Buckeye Institute commented on newly released employment data from the Ohio Department of Job and Family Services, saying, “July’s job numbers show moderate job growth for Ohio, but the outlook is foggy for the end of the year. With Ohio’s unemployment rate rising slightly to 4.6 percent and a sustained labor force participation rate, Ohio has reversed its trend of positive job growth, and the insecurity caused by the current federal trade policies is starting to seep into the state’s job market.”

Following the U.S. Supreme Court’s Janus v. AFSCME decision, The Buckeye Institute filed two separate lawsuits and corresponding preliminary injunctions calling for an immediate end to the laws that force public-sector employees to accept their union’s representation. “The Janus decision was an important victory for hardworking public servants across the country, but many of these same employees are still forced to accept their union’s representation that they didn’t ask for and do not want.”

The Buckeye Institute has secured the first major post-Janus v. AFSCME legal victories for two of its clients. In cases in Maine and Minnesota, a public-sector union granted a member’s demand to immediately cancel full union membership and cease withholding union dues, without requiring the union member to wait weeks or months until the designated opt-out window or comply with any other opt-out rules or procedures—any of which would be unlawful under Janus.

The Buckeye Institute commented on newly released employment data from the Ohio Department of Job and Family Services, saying, “Halfway through 2018, Ohio is on track for a year marked with solid job growth and a strengthening labor market…This growth has been fostered by the federal tax reform and Governor John Kasich’s tax policies, which have created an economic environment conducive to job creation. However, current federal trade policies could hinder this growth in the months to come.”
